1. SCOPE OF APPLICATION

1. The general terms and conditions set forth herein (hereinafter: “T&C”) apply to all orders and purchases of products on the website https://arcucci.it.com (hereinafter: “Website”) managed by Arcucci Trade S.r.l., headquartered at Via delle Padulette 4/6, 51011 Buggiano (PT) – Tax Code and VAT No. 01419560477.

2. WARNINGS

1. 1. The Customer is required to carefully read the T&C before placing any purchase order. By accepting the T&C and submitting an order, the Customer declares:
   a) to have read, understood, and fully and unreservedly accepted the T&C;
   b) to authorize Arcucci Trade S.r.l. to store, process, use, and transfer to third parties and/or abroad the (personal) data contained in the order for the purpose of executing it.
2. Arcucci Trade S.r.l. will do its best to ensure that the information on the Website is accurate and up-to-date. However, no guarantees can be provided in this regard. The Customer acknowledges and accepts that the Products may not fully comply with the descriptions, specifications, and/or photographs displayed on the Website.

3. ORDERS

1. The sales contract between Arcucci Trade S.r.l. and the Customer is deemed finalized upon the sending of a written shipping confirmation to the Customer at the email address provided in the purchase order.
2. Arcucci Trade S.r.l. will consider any order cancellation requests received before the shipment of the Products to the Customer.
3. If a specific Product ordered by the Customer is no longer available, Arcucci Trade S.r.l. shall have no obligation to supply that Product but will only be required to promptly inform the Customer of such circumstance. If only some of the Products in the order are available, Arcucci Trade S.r.l. will contact the Customer to ask whether they wish to cancel the order or receive only the available Products; in this case, the Customer will only be charged for the Products they receive.
4. Arcucci Trade S.r.l. reserves the right, at its sole discretion, to limit the quantity of Products that can be purchased on the Website.
5. Measurements, features, and illustrations of the Products are indicative and subject to change without notice if required by technical-production needs. As production is artisanal, slight variations may occur between different batches of the same product.

4. PRICES

1. The prices of the Products, expressed in the currency displayed in the shopping cart, will in any case be those indicated on the invoice. Arcucci Trade S.r.l. will make every effort to ensure that the prices listed on the Website are correct and up-to-date.
2. Shipping costs may vary depending on the country and will be charged to the Customer at the time of shipment of the ordered Products, based on the applicable shipping rates for private Customers and based on the weight/volume ratio of the package for Companies and Professionals.
3. Payment will be made:
   a. By private Customers upon shipping confirmation using a credit card or other payment methods specified in the relevant section of the Website.
   b. By Companies or Professionals using the payment methods and terms agreed upon with Our Company, as stated on the invoice.

5. DELIVERY

1. The delivery of the Products will be made to the delivery address specified by the Customer in the order.
2. As a general rule, Products will be delivered within 30 (thirty) days from the order confirmation by Arcucci Trade S.r.l., provided that delivery times may vary depending on the destination country. If delivery is delayed for reasons beyond Arcucci Trade S.r.l.’s control, the Customer will be informed, as far as possible, of the new delivery date.
3. Arcucci Trade S.r.l. reserves the right, at its sole discretion, to refuse, suspend, or cancel the delivery or fulfillment of any obligations arising from the sales contract in cases of suspected fraud, non-compliance, or violation by the Customer of obligations assumed in previous orders and/or sales contracts. If the ordered Products require customs clearance (depending on the destination country) and the Customer decides not to receive the order once it has reached customs, Arcucci Trade S.r.l. will not grant a refund, and the goods will be abandoned on-site.

6. COUPONS AND ONLINE DISCOUNT VOUCHERS

1. Customers may use coupons and online discount vouchers only as specified in the coupon itself and on the website.
2. Coupons and discount vouchers cannot be combined with each other unless otherwise stated.
3. Some products may be excluded from promotions. Arcucci Trade S.r.l. reserves the right to modify the terms of use of coupons and discount vouchers at any time.

7. RIGHT OF WITHDRAWAL

1. The Customer has the right to withdraw from the purchase contract within 14 (fourteen) days from the date of receipt of the Products, without providing any reason.
2. To exercise the right of withdrawal, the Customer must send a written communication via email to [contact email], indicating the order number and the products they wish to return.
3. The products must be returned in the same condition in which they were received, in the original packaging, and must not have been used. Return shipping costs are borne by the Customer.
4. Once the returned products are received and their integrity verified, Arcucci Trade S.r.l. will refund the amount paid by the Customer within 14 (fourteen) days of receiving the return.

8. WARRANTY AND LIMITATION OF LIABILITY

1. All Products sold by Arcucci Trade S.r.l. are covered by the legal warranty for conformity defects, in accordance with the Consumer Code (Legislative Decree 206/2005).
2. In case of defects or non-conformities, the Customer must report the issue within 2 (two) months of discovery by sending a written communication to [contact email] and attaching photos of the detected defect.
3. Arcucci Trade S.r.l. will evaluate the claim and, if the defect is confirmed, will proceed with the replacement of the product or a refund of the amount paid.
4. Arcucci Trade S.r.l. is not liable for damages resulting from improper use of the Products or accidental damage caused by the Customer.

9. GENERAL PROVISIONS

1. These General Terms and Conditions of Sale are governed by Italian law.
2. In case of disputes, the competent court shall be that of Pistoia, unless otherwise required by mandatory legal provisions.
3. If any clause of these General Terms is found to be invalid or unenforceable, this shall not affect the validity of the remaining clauses.
4. Arcucci Trade S.r.l. reserves the right to modify these General Terms and Conditions at any time without prior notice. The changes will be effective from the date of publication on the website.
